CONDITIONS OF USE


The following terms concern sales on the websites of La Boutique Airelles, boutique@airelles.com, concluded between a non-trading natural person and LOV HOTEL COLLECTION (LHC).

These conditions apply to the exclusion of all others, including those applicable to in-store sales.

LHC reserves the right to modify its general terms and conditions of sale. The aforementioned terms will be applicable from the date they are published online and will apply to all orders placed from that date onwards.

Article 1. La Boutique Airelles' product range:

PERIOD OF VALIDITY

The offers on the Site are valid while they are displayed online.

FOOD STORAGE ADVICE 

We advise you to store food in a cool, dry place. Keep perishables in the refrigerator and consume within the time specified on the packaging. Read the labels carefully to benefit from very useful information, especially when preparing or serving our specialities.

 Article 2 Product availability: 

PRODUCT INFORMATION 

La Boutique Airelles pays careful attention to the description of each product on the website and states, for each one, a full description, the quantity, price, and the payment methods accepted by La Boutique Airelles.

PRODUCT QUALITY

La Boutique Airelles pays careful attention to the quality of the Products for sale on the Site. Products are stored in optimal conditions and are prepared and packaged according to strict quality regulations.

PRODUCT AVAILABILITY

All products on the website are available and our offers are subject to availability of stock.  
Should we find that a product is unavailable after you have placed your order, we will inform you by email or telephone within 24 hours (on working days). 
You will then be able to request the cancellation of your order or a replacement for the unavailable product(s).

Article 3 Ordering:

CREATING AN ACCOUNT

To place an order, you can create a customer account on the Site. You must therefore provide your personal data. For more information regarding the use of your personal data, we invite you to consult our Privacy Policy. You confirm that the information provided to La Boutique Airelles is genuine, accurate and up to date. You can update and correct your data at any time through your customer account.

You must choose a username and password to access your account. You must not share this information with anyone. La Boutique Airelles may not be held responsible for any loss or damage incurred as a result of your failing to protect your username or password. If you have forgotten your password, the Site gives you the option to retrieve it using your email address.

ORDER CONFIRMATION

Orders are confirmed according to the following procedure:

-        Select your products by placing them in the basket

-         Select your delivery method

-         Confirm the contents of your basket

-         Sign in to your customer account or create an account

-         Consult the delivery information (delivery method, cost and times)

-         Enter billing information

-         Agree to delivery terms and conditions

-         Verify and validate your order and accept the General Terms and Conditions by ticking the appropriate box

-         Information and validation of the payment.

At each stage of the order process and before validation, the Customer may correct or modify his or her choices. The information provided by the Customer when placing the order is legally binding. In the event of an error made by the Customer in the wording of his or her contact details or those of the recipient or the delivery address (in particular the surname, first name, address, telephone number, e-mail address, entry code, or floor) resulting in the loss of the Products, the Customer will be liable for payment of the lost Products, and no compensation or refund will be issued. It is therefore the Customer's responsibility to check the accuracy of the order and make any changes before validating the payment.

The Customer's confirmation of the order implies acceptance of all these Terms and Conditions. Once the Customer confirms the order, the order is automatically confirmed. No changes will be taken into account by the Seller.

ORDER CONFIRMATION

When you click the "Confirm" button following the order process, you thereby declare that you accept the order along with these General Terms and Conditions of Sale in their entirety and without reservation.

Upon confirming the order, the Customer also confirms understanding of his or her obligation to pay.


LHC sends a confirmation message to the Customer by e-mail to the address indicated by the Customer in order to provide a summary the Products ordered, the delivery address, date and method, the payment method and order number.

LHC reserves the right to cancel or refuse any order from a Customer with whom there is an outstanding dispute relating to the payment of a previous order, or anyone it considers to present any form of risk.

ORDER CHANGES:

Any changes the Customer wishes to make to an order after confirmation from La boutique Airelles are subject to prior acceptance by LHC.

 Article 4 Shipping and handling fees: 

SHIPPING IN FRANCE 

The flat-rate fee varies depending on the shipping method you choose:

- Chronopost: the fee is €14.90, for purchases equating to €100 or more, the fee is €11

 At present, we do not ship outside of France.

Article 5. Terms of payment: 

The products are supplied at the prices appearing on the Site at the time the order is confirmed.

We accept card payment by (Credit, Debit, Visa, Mastercard/Eurocard, Diners Club, Cofinoga, Aurore and American Express).

Article 6 Order processing and delivery times: 

FOR ALL SHIPPING IN FRANCE

Following dispatch from our Logistics Department, your order will be delivered in:
- 24 hours - 48 hours by Chronopost.

These time frames concern working days, excluding postal delivery problems, and according to product availability.

In accordance with the provisions of the French Consumer Code, orders will be delivered no later than thirty days following order confirmation. Should this delivery time not be respected, the consumer has the right to request the cancellation of the order. Such requests should be made by recorded delivery with acknowledgement of receipt. The Customer will then receive a full refund by any means of payment, or a credit note if desired.

La Boutique Airelles is not responsible for irregular or longer than expected delivery times. The advised delivery times are usually respected. These indications are given for information purposes only and are non contractual.

From delivery, (i.e. the moment you physically receive your package), the Products become entirely your responsibility.

Article 7 Duties and taxes: 

VAT

The regulations are set by the European Union.
Shipping to an EU country: Invoices include French VAT.

Shipping outside the EU: Invoicing is free of taxes and duties (any duties payable at the destination are the responsibility of the Customer).

Article 8 Receipt of goods:

The Products are received at the time the Customer takes physical possession of the Products (the "Receipt"). The Customer is required to check the condition of the Products at the moment of Receipt. In the event of missing, lost or damaged items, the Customer must inform:

-           The seller, if the Products are collected from a pick-up point.

-           The carrier, if the Products are delivered to the Customer's home or by courier, specifying, on the delivery slip, the nature and extent of the damage.

The Customer must confirm any problems in writing (email or letter) to Customer Services within three (3) days of receipt. The claim must be accompanied by a photograph clearly showing the damage to the Product. After this period, Products received will be considered free of any defects.

LHC will refund or replace at its own expense any non-conforming or defective products.

 

Article 9 Legal assurances, right of withdrawal: 

LEGAL ASSURANCES

In accordance with the legal provisions in place (the French Consumer Code and Civil Code), the Products provided by LHC are legally assured against latent defects, and compliance is guaranteed.

Article 10. Right of withdrawal: 

If your order is not suitable or you have changed your mind, for any reason, you can return your products to us under certain conditions.

RETURNS POLICY

Returns or exchanges are accepted if they are returned in their original packaging as new a maximum of fourteen (14) days after receipt. A refund or exchange will be granted upon request.

Should the return be accepted, the Product must be returned in its original condition and packaging with proof of purchase. Shipping costs will be reimbursed at the invoiced rate, and return costs, in the event of a complaint, (excluding the use of the right of withdrawal) will be reimbursed upon presentation of supporting documents.

CAN ALL ITEMS BE RETURNED?


 (i) Nightgowns, slippers, and used or washed robes are non-returnable.

(ii) Fresh and perishable products, in accordance with the precautionary principle, and to guarantee safety, cannot be returned once they are no longer in our care.

(iii) Goods that cannot be returned for reasons of hygiene or health will not be accepted for return once the packaging has been removed by the Customer.

To find out whether a Product is eligible for the right of withdrawal, the Customer can consult the Product description in the "Legal Information" section. 

HOW DO I RETURN AN ITEM?

Returns are free of charge if you use the return slip you received with the delivery.

When sending items to our returns department, be sure to use tracked and insured post. Please include a copy of the invoice and a note with your address and daytime contact number, along with your instructions, and send to:

TERMS OF REIMBURSEMENT


La Boutique Airelles
will reimburse the Customer no later than ten (10) days after receipt of the appropriate bank details (IBAN and SWIFT code). No withdrawal made by the Customer after the deadline will be taken into account. Consequently, no refund will be issued to the Customer.

The Customer will be held liable for any damage to the Products resulting from handling them in any way other than is necessary to observe their state, and the amount refunded will thus be reduced.

The identity, brand or commercial nature of any email marketing will be clearly specified in the subject line of the message. At the bottom of the message, you will also find a link to click on should you wish to opt out of receiving any further email marketing.

In addition, any use of e-mail databases must be declared to the CNIL (National Commission on Informatics and Liberty). 


 

Article 12 Intellectual property: 

The copying of any documents published on the boutique@airelles.com website is authorised solely for information purposes and for personal and private use. Any reproduction and any use of copies made for other purposes is strictly prohibited. All content, photographs and other documents on this site are the property of LHC, or are published with the permission of their owners, and are subject to copyright and other intellectual property rights.

The trademarks, logos and designs on this site belong to LHC. No representation may be made for a user licence or for any right to use the trademark displayed on the website.

Fraudulent use of the trademark or any other content on the website is strictly prohibited. In particular, it is prohibited to copy, reproduce, represent, modify and/or exploit, in any way whatsoever and for any purpose whatsoever, all or part of the structure and content of the boutique@airelles.com site. La boutique Airelles will exercise its intellectual property rights extensively to initiate legal proceedings if necessary.
 Any dispute will be referred to the Competent Court on which LHC depends, in accordance with French law.
